Trees on a Property Line
/We’ve recently had several questions from homeowners about trees located on property lines, and we thought this was the perfect time to address some of the most common concerns and Indiana laws surrounding boundary trees.
Property line trees can quickly become a source of confusion between neighbors. This especially happens when branches begin hanging over a driveway, roots start affecting the lawn, or the tree raises safety concerns. Understanding who owns the tree and what rights each property owner has under Indiana law can help prevent disputes and protect both your property and your relationship with your neighbor.
In Indiana, a tree with its trunk on the property line is considered shared, "boundary" property. Both neighbors own it, and neither can legally remove or damage it without mutual consent. You may trim branches extending over your property line, provided it does not kill the tree.
Key Considerations for Property Line Trees:
Who owns the tree? If the trunk sits on the line, it is shared. If the trunk is entirely on one neighbor’s side, that person owns the tree, even if roots/branches cross over.
Who has trimming rights? You have the right to prune branches or roots that overhang or encroach upon your property (encroachment).
What are the limits? You cannot destroy or cause the tree to die, which could make you liable for the value of the tree.
Can the tree be removed? A shared tree cannot be removed without the consent of both parties.
What should you do if you have concerns about a tree?
Document: Take pictures of the tree in relation to the property line.
Consult an Expert: Hire a certified arborist to perform a tree risk assessment if the tree is hazardous.
Legal Action: If a dangerous, dead tree is on a neighbor's property and they refuse to act, city governments might intervene.
